Terms of Use

1. Acceptance and eligibility

These Terms are between you and Souqly Marketplace, the operator of Souqly. By creating an account, publishing a listing, sending a message or offer, or otherwise using Souqly, you agree to these Terms, the Privacy Policy, and the Safety Rules. You must have legal capacity to enter a binding agreement. If you use Souqly for a business, you confirm that you may bind that business.

Do not use Souqly if applicable law prohibits you from doing so. Mandatory consumer and privacy rights continue to apply and are not waived by these Terms.

2. Souqly’s marketplace role

Souqly provides classified listings, discovery, messaging, offers, reporting, and moderation tools. Unless a listing expressly says otherwise, Souqly does not own, inspect, store, deliver, broker, insure, or guarantee listed items or property. Buyers and sellers contract directly with each other; Souqly is not a party to their transaction.

Verification badges and moderation signals reduce risk but are not guarantees of identity, ownership, quality, legality, safety, payment, or performance.

3. Accounts and credentials

• Provide accurate, current information and keep it updated.
• Use a strong, unique password and enable two-factor authentication when available.
• Keep your phone, email, password, OTPs, recovery codes, and active sessions secure.
• Do not sell, transfer, impersonate, or share an account.
• Notify Souqly immediately if you suspect unauthorized access.

Activity performed through your account may be treated as yours where reasonable, but you may report unauthorized use for investigation. Souqly will not ask you to forward an OTP or approve an unfamiliar login.

4. Listings and user content

You are responsible for the accuracy, legality, ownership, condition, price, images, claims, and required disclosures in your listing. Do not list stolen, counterfeit, unsafe, recalled, illegal, regulated without authorization, misleading, discriminatory, infringing, or prohibited goods or services.

You retain ownership of your content. You grant Souqly a worldwide, non-exclusive, royalty-free licence to host, format, display, reproduce, and distribute that content only as reasonably needed to operate, promote, secure, and improve the marketplace. You confirm that you have the necessary rights to grant this licence.

5. Direct transactions, offers, and payments

Offers made through Souqly are communications between users. Unless explicitly implemented and identified as a Souqly checkout service, payment, inspection, delivery, title transfer, returns, warranties, taxes, invoices, and disputes are arranged directly between buyer and seller.

• Inspect before paying and use traceable, lawful payment methods.
• Do not pay deposits merely to “reserve” an item without verification.
• Do not follow payment links or QR codes sent by strangers.
• Businesses must comply with consumer, tax, licensing, invoicing, warranty, return, and product-safety obligations.

6. Property listings

Property content is advertising information, not legal, financial, valuation, surveying, title, or investment advice. A listing does not prove title, authority to sell or lease, permitted use, approvals, absence of encumbrances, or physical condition. Independently verify the owner or licensed agent, title and registration records, approvals, measurements, utilities, service charges, tenancy status, and contract terms. Use qualified local legal and property professionals before paying a deposit or signing.

7. Personal information and scam safety

Use Souqly chat for marketplace discussion. Share only the minimum information needed to complete a transaction. Never send identity-document copies, card details, bank login information, OTPs, passwords, PINs, or recovery codes to another user. Meet in a safe public place when practical and tell someone where you are going.

If you choose to disclose personal or security information to another user, that disclosure is at your risk. Nothing in this section reduces Souqly’s independent duties to protect data it controls or your non-waivable legal rights.

8. Moderation and enforcement

Souqly may review, restrict, reject, remove, or preserve content; limit features; suspend or close accounts; and cooperate with lawful authorities where reasonably necessary for safety, legal compliance, fraud prevention, or enforcement. Automated and human review may make mistakes. You may contact support to request review of a decision.

Report suspected scams, dangerous listings, impersonation, rights violations, or abusive conduct. Do not misuse reporting or review systems.

9. Disclaimers and limitation of liability

The service is provided on an “as available” basis. Souqly does not guarantee uninterrupted access, a successful sale, the truth of user content, or another user’s conduct. To the maximum extent permitted by applicable law, Souqly is not liable for indirect, incidental, special, consequential, or punitive loss arising from a user-to-user transaction, voluntary credential disclosure, an off-platform payment, or reliance on a listing.

Nothing in these Terms excludes liability or remedies that cannot lawfully be excluded, including liability arising from Souqly’s fraud, wilful misconduct, gross negligence where applicable, breach of mandatory data-security duties, or statutory consumer rights.

10. Changes, applicable law, and contact

We may update these Terms for legal, safety, or service changes. We will change the version date and provide additional notice where required. Continued use after an effective update means acceptance where permitted; we will request renewed consent when required.

The law applicable to your use may depend on the Souqly market, your residence, the seller’s status, and mandatory local rules. Nothing here prevents you from using a regulator, consumer forum, court, or dispute process available under non-waivable law.
